Ethiopia Patents

Filing Requirements:

1. Power of attorney, legalized.

2. Specification and abstract in English in triplicate.

3. 3 sets of formal drawings.

4. Copy of the basic application, if priority is claimed, certified.

5. Deed of assignment from the inventor(s), legalized.

* All the above documents must be submitted at the time of filing.

Opposition:

Decisions to grant a patent are published in the Official Gazette. Oppositions may be filed within 60 days from publication date.

Search:

It is possible for granted and published inventions in the Official Gazette to be searched by title and subject matter.

Examination:

As to form, novelty, and industrial applicability.

Annuities:

A maintenance fee is due annually on the anniversary of the filing date and is payable before the granting of the patent. There is a 6-month grace period for late payment with a surcharge.

Protection Term:

The term of protection is 15 years from filing date and can be extended for a further period of 5 years if proof is furnished that the invention is properly worked in Ethiopia.

Compulsory License:

A patent has to be worked. If the patent is not being fully exploited by the patentee within 3 years from the date of grant or 4 years from the filing date then the patent will be subject to compulsory licensing under the provisions of the law.

Novelty Requirements:

Absolute novelty is required. However, all types of disclosure by the inventor as well as disclosure of information without the knowledge or consent of the inventor shall not be taken into consideration if occurred within the 12-month grace period preceding the filing date of the patent application.
